1. General Conditions of Use
We invite you to read carefully the present General Conditions of Use (or "General Conditions") before using Costruire Audio services. By using Costruire Audio services and forwarding a purchase order on our website you fully accept the present General Conditions of Use.
Seller of products on the site Costruireaudio.com is COSTRUIRE AUDIO of Salvatore Spatafora, with headquarters in via Galilei 21A 34126 - Trieste (TS) - ITALY, tax code SPTSVT85M19C352P, VAT number 01231220326, telephone +39 040 228260, (hereinafter referred to as Costruire Audio).
These general conditions of sale ("General Conditions") are governed by the Consumer Code (D. Lgs. n. 206/2005), section II, Distance Contracts (Articles 50 - 67), by the provisions of the Civil Code on contracts of sale to articles 1490 and ss., and by the rules on electronic commerce (D. Lgs. n. 70/2003) and apply to the sale of products on the Internet site of Costruire Audio.
Costruire Audio reserves the right to modify these General Conditions, subject to notice published on the site. In case of changes in General Conditions, the purchase order will be applied to the General Conditions published on the site at the time the order is sent by the customer.
The products and their prices presented on the website constitute an offer to the public, in accordance with the procedures specified in the General Conditions and on the website itself.
Please note that to purchase products on the site of Costruire Audio is necessary to be of age. In the case of purchases made by a minor, parents or the person who exercises guardianship will be considered jointly responsible.
To submit a purchase order, the customer has the following procedures available
- by e-mail, using the Antispam "Contact us" form

- by mail, by sending a purchase proposal to Via Galilei 21A 34126 - Trieste (Italia) - ITALY;
- directly on the site - the customer successfully completes the order process if the site does not show any error messages:
For already registered customers, it will be sufficient to enter their access credentials (username and password) in the "Login"/"Account" and "Already registered customer" sections and follow the purchase procedure presented;
If the customer wishes to proceed with the purchase without registering, it will be sufficient to access the "Purchase as a guest" section and enter the requested data in the appropriate form. In this way the data provided will be used only to proceed with the purchase and will not be included in the database of registered users of Costruire Audio;
To submit a purchase order the customer must provide the following data: name, surname, delivery address, payment method, postal/phone/email address - in the case of purchases made by private individuals; name/company name, tax code and VAT number, registered office, delivery address, payment method, postal/phone/email address - in the case of purchases made by companies/freelance professionals.
In all cases, customers are advised to contact Costruire Audio by email and/or telephone before proceeding with the order, in order to obtain all information on the products requested and how to purchase.
Costruire Audio will acknowledge receipt of the purchase order by sending an email of "Order Confirmation Receipt" to the email address provided by the customer. This confirmation will summarise the chosen products, their availability in stock, relative prices, shipping costs, delivery address and order number.
The customer undertakes to verify the accuracy of the data contained in the order confirmation and to communicate any corrections within 24 (twenty-four) hours of receiving it. Any additional costs incurred due to errors in the data not reported in time shall be borne by the customer. The order number must be used by the customer in any communication with Costruire Audio. It is possible that occasional non-availability in stock of the products offered may occur; in this case, if the products chosen by the customer are not, in whole or in part, immediately available, Costruire Audio will inform the customer in the "Order Confirmation" email.
The purchase contract will be concluded when Costruire Audio will send the customer the email of "Order Confirmation", containing all the conditions listed above.
In case of purchase by bank transfer, Postepay recharge or Paypal, Costruire Audio will proceed with the shipment of the chosen products only after receipt of payment. The customer will be sent an email "Shipping Confirmation" when the products will be taken over by the courier responsible for delivery.
The prices of the products on the site are unitary and include 22% VAT (next to each amount there is also the specification of the taxable amount - excluding 22% VAT - useful for purchases by companies / professionals).
The Customer expressly acknowledges that the indication of a VAT number in the purchase order automatically qualifies him/her as a company/self-employed person - therefore, the rules contained in the Consumer Code (Legislative Decree 206/2005) shall not be applied to such transactions; instead, reference shall be made to the provisions of the Civil Code, articles 1490 et seq. on sales contracts.
2. Warranty
All products purchased on Costruire Audio are covered by warranty, as governed by D. Lgs. n. 206/2005 (Consumer Code) and the Civil Code, in the part devoted to the contract of sale, at Articles. 1490 et seq.
What is the warranty?
Warranty means the commitment made by Costruire Audio to the customer to repair or replace free of charge and within a reasonable period of time the products or components of the equipment that have defects of conformity in workmanship or material. If the repair or replacement of the good should be excessively expensive or problematic, the customer can obtain a price reduction or termination of the contract. In determining the amount of the price reduction or the amount to which the customer is entitled in such cases, the use made of the product shall be taken into account.
Please note that minor defects for which repair or replacement is not possible or is too costly do not entitle you to cancel the contract.
If the product you have purchased is defective, please contact us immediately so that we can find the solution that best suits your needs.
Different customers, different ways to exercise the warranty
For consumers - i.e. "natural persons acting for purposes which are outside their trade, business or profession" (art. 3, paragraph 1, letter a) of Legislative Decree 206/2005) - the warranty extends to two years after delivery of the goods.
To exercise your right, you must notify us of the lack of conformity that you have found within and no later than 60 (sixty) days from discovery.
For the first six months after delivery of the product, the conformity defect is presumed to have existed from the outset, so the application of the guarantee is automatic. From the seventh month until the end of the two-year period, however, the lack of conformity must be demonstrated by means of an expert's report at your expense.
The consumer, in any case, is entitled to the rights provided for by the Consumer Code articles 128 - 135, which are not modified by this guarantee.
To those who, however, buy a product on Costruire Audio for purposes related to their business or professional activity - communicating, therefore, the VAT number and data of their business - will be applied the provisions of the Civil Code on contracts of sale, to articles 1490 et seq.
The warranty, therefore, extends to 12 (twelve) months following delivery of the goods, while notification of the lack of conformity must be made within 8 (eight) days of discovery.

The warranty will be acknowledged upon presentation of the Certificate issued by the manufacturer and contained in the packaging (if present), together with the original purchase invoice or sales document.
The warranty does not cover:
- Accidental damage or damage caused by loss, non-use of the product, tampering, normal wear and tear, or loss of information made available to the customer at the time of sale.
- Damage that may, directly or indirectly, result to people, things or animals as a result of failure to observe the requirements set out in the operating manuals and concerning, especially, the warnings on the installation, use and maintenance of the product. Costruire Audio declines any kind of responsibility for such damages.
- Damage caused by carelessness, incorrect use and installation that does not comply with the warnings and indications given in the instruction or installation manual; damage caused by misuse, mistreatment, deterioration, lightning, atmospheric phenomena, overvoltage and overcurrents, insufficient or irregular power supply, adaptation or modification, nor damage caused by incorrect use or in contradiction with the technical and safety measures required in the country where the equipment is used.
- Damage or malfunctions resulting from replacements or repairs carried out directly by the customer or by third parties, using parts not authorised by the relevant manufacturers or not complying with the appropriate safety and quality measures.
- Consumable parts subject to normal wear and tear, such as bulbs, lamps, batteries, etc.
3. Right of withdrawal
Purchases made on the Costruire Audio website are regulated by Italian legislation on distance contracts and purchases outside commercial premises, which can be found in Legislative Decree no. 206/2005, better known as the Consumer Code.
We undertake to refund the full amount as soon as possible and in any case within the legal term of 14 (fourteen) days from the date on which we receive the goods back. Payments fees will not be refounded
The consumer has the right to withdraw from the contract, without giving reasons, within 14 days. The withdrawal period expires after 14 days from the day on which you or a third party, other than the carrier and designated by you, acquires physical possession of the goods.
In order to exercise your right of withdrawal, you must inform us (insert your name, geographical address and, if available, your telephone number and e-mail address) of your decision to withdraw from this contract by means of an explicit statement (e.g. letter sent by post, fax or e-mail). In order to comply with the withdrawal period, it shall be sufficient for you to send the communication concerning the exercise of the right of withdrawal before the end of the withdrawal period.
Effects of withdrawal
If you withdraw from this contract, we shall refund all payments you have made to us, including the costs of delivery (except for additional costs resulting from your choosing a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw from this contract.
Such refunds will be made using the same means of payment as you used for the initial transaction, unless we have expressly agreed otherwise; in any event, you will not incur any costs as a result of such refund. The refund may be suspended until you have received the goods or until you have proved that you have sent the goods back, whichever is the earlier.

without unjustified delay and in any case within 14 days from the day in which you communicated us your withdrawal from this contract. The deadline is met if you return the goods before the 14-day period has expired.
"You shall bear the costs of returning the goods.",
The consumer is only liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics and functioning of the goods.
In these cases, however, we always advise you to contact us, to provide you with further information and to find together the best solution for the return of the goods, including through our couriers.

Consumer or non-consumer?
The protection of the Consumer Code applies to consumers or users, i.e. to "natural persons acting for purposes which are outside their trade, business or profession" (art. 3, paragraph 1, letter a) of Legislative Decree 206/2005). The right of withdrawal as presented here, therefore, cannot be exercised by legal persons and natural persons acting for purposes related to a commercial and/or professional activity. Purchases made by resellers or by persons who in any capacity purchase for resale to third parties are also excluded.
What if we have made a mistake?
If you have received an item that you did not want because of an error on our part, the right of withdrawal remains unaffected, but obviously the shipping costs for returning the goods will be borne by us. Please contact us to find the simplest and quickest solution.
Damaged products
Should you receive damaged goods, please let us know within 5 (five) working days by email or telephone, quoting "damaged items" in the subject line of the email, or by telephone.

7. Competent Court
For civil disputes governed by the Consumer Code (Legislative Decree 206/2005), the competent Court shall be the Court of the place of residence or domicile of the consumer, if located in the territory of the Italian State.
For any other dispute, the competent Court shall be the Court of Trieste (Italy).
